Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and MPDialer LLC ("MPDialer," "we," "us") governing your use of the Rooster mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What Rooster does

Rooster is a personal reminder and wake-up assistant. Instead of a beep, it rings your device with an incoming call in an AI voice at the times you schedule — an in-app call delivered over the internet, not a traditional (PSTN) phone call. It can converse with you, call back if you snooze or don't answer, and set an on-device backup alarm. You create reminders by chatting with the app in plain language.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your region) and able to form a binding contract to use the Service. The Service is intended for your own personal, non-commercial use.

3. Your account

You sign in with your phone number, verified by a one-time SMS code. You are responsible for the activity on your account and for keeping access to your phone number secure. Reminders and wake-ups you schedule ring your own device. The optional Friends feature lets you and people who have connected with you in the app send each other wake-ups and messages, delivered in-app to the recipient's own device.

4. Calls, texts, and your consent

By verifying your number and accepting the in-app consent, you authorize Rooster to place automated and AI-generated voice calls to your device and send SMS to the number you verified, to deliver the reminders and wake-up alarms you schedule — including follow-up call-backs if you snooze or don't answer. If you use Friends, you also authorize Rooster to deliver wake-ups and messages that friends you've connected with send you; you can decline, report, block, or unfriend at any time. Consent is not a condition of any purchase. Message and data rates may apply. You can stop calls at any time by saying "stop" on a call, turning a reminder off in the app, blocking a friend, or deleting your account. See our SMS Terms and Privacy Policy for details.

5. Not for emergencies or critical alerts

Rooster is a convenience tool, not a life-safety or emergency service. Do not rely on it for time-critical or safety-critical needs — for example, life-sustaining medication, medical emergencies, or any situation where a missed or delayed reminder could cause harm. Calls and notifications can be delayed or fail for reasons outside our control (carrier issues, device settings such as silent mode or Do Not Disturb, connectivity, or outages). You are responsible for maintaining independent means for anything critical.

6. Subscriptions and billing

Some features require a paid subscription, sold as an in-app purchase and billed through your Apple ID via Apple / RevenueCat. Subscriptions auto-renew at the then-current price until cancelled at least 24 hours before the end of the current period. You manage or cancel your subscription in your device's Settings → Apple ID → Subscriptions. Payments, refunds, and cancellations are handled by Apple under the terms of the App Store; we do not process your card and generally cannot issue refunds directly. Free-tier limits and paid features may change over time.

7. Acceptable use and user content

You agree not to use the Service to: act on behalf of anyone other than yourself; harass, deceive, threaten, bully, or harm anyone; post, send, or share content that is unlawful, hateful, sexually explicit, harassing, abusive, or otherwise objectionable; violate any law (including telemarketing, calling-time, or do-not-call laws); attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; or resell or commercially exploit the Service.

Friends and user content. Wake-ups and messages you send to friends are your content. There is zero tolerance for objectionable content or abusive behavior. We screen this content automatically before it plays and may remove any content and suspend or terminate any account that violates these Terms. You can report or block a friend at any time from within the app; we review every report and act within 24 hours, removing offending content and ejecting repeat or serious offenders. By connecting with a friend you consent to receive the wake-ups and messages they send until you decline, block, or unfriend them.

8. Intellectual property

The Service, including its software, design, and content (excluding the reminders and profile you provide), is owned by MPDialer LLC and its licensors and is protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app for your personal use. You retain your own content; you grant us the license needed to operate the Service for you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CALLS OR NOTIFICATIONS WILL BE TIMELY, UNINTERRUPTED, OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MPDIALER LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM A MISSED, DELAYED, OR FAILED REMINDER OR CALL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.

11. Indemnification

You agree to indemnify and hold harmless MPDialer LLC from claims, damages, and expenses arising out of your misuse of the Service or violation of these Terms or of any law.

12. Dispute resolution; arbitration

Except where prohibited by law, any dispute relating to the Service will be resolved by binding individual arbitration on a non-class basis, and you and MPDialer LLC waive the right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@mpdialer.com. Nothing here prevents either party from seeking relief in small-claims court.

13. Governing law

These Terms are governed by the laws of the State of California and applicable United States federal law, without regard to conflict-of-laws rules.

14. Changes and termination

We may update these Terms as the Service evolves; material changes will be surfaced in the app or by other reasonable means, and continued use means you accept them. You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms or to protect the Service.
